The government is now operating in accordance with the Guidance on Caretaker Conventions, pending the outcome of the 2025 federal election.
The Therapeutic Goods Administration (TGA) has issued ATP Science Pty Ltd (ATP Science) with 24 infringement notices totaling $302,400.
The infringement notices are for the alleged advertising of a number of therapeutic goods not included in the Australian Register of Therapeutic Goods (ARTG). The TGA alleges that ATP Science made a number of claims in relation to the goods, including prohibited representations relating to cancer and the treatment of mental health conditions, along with restricted representations. The use of prohibited and restricted representations in advertisements for therapeutic products is unlawful without the express permission of the TGA.
The TGA takes action against unlawful activity
The TGA oversees the regulation of medicines and medical devices that are used in Australia, and implements a range of compliance and enforcement tools to detect, deter and address unlawful trade in unapproved therapeutic goods. Where necessary this may include criminal or civil court proceedings, which can result in substantial penalties, fines or imprisonment.
Businesses and individuals must comply with the therapeutic goods advertising requirements when advertising medicines and medical devices in Australia.
