Nature’s Puff Pty Ltd and director fined $105,600 for alleged unlawful advertising of nicotine vaping products

The Therapeutic Goods Administration (TGA) has issued 8 infringement notices totalling $105,600 to Nature’s Puff Pty Ltd and a director, for the alleged unlawful advertising of 8 flavours of 2 disposable nicotine vaping products on their website.

Six infringement notices totalling $99,000 were issued to the company, and 2 notices totalling $6,600 were issued to the director.

On 2 May 2023, the Minister for Health and Aged Care announced that the Australian Government is taking strong action to combat unlawful vaping products.

Nicotine vaping products are prescription-only medicines which cannot be advertised to the public. Individuals and businesses are not permitted to advertise these products in any way. 

The TGA reminds individuals and businesses that unlawful advertising of nicotine vaping products is a breach of the Therapeutic Goods Act 1989 for which serious penalties can apply including fines and civil or criminal court action.

The TGA granted a legal permission allowing only pharmacies and pharmacy marketing groups to advise where a person can fill their prescription for a nicotine vaping product, without mentioning specific brands or types of products.

These infringement notices follow infringement notices of $588,840 recently issued to a group of companies for the alleged unlawful import of nicotine vaping products that contained prohibited ingredients and did not comply with the relevant standard, as well as two civil court actions that are well under way for the alleged unlawful advertising of nicotine vaping products.
